Rights
NatureServe reserves all rights in all intellectual property provided. No interest whatsoever is conveyed in right, title and interest in the data, the information, intellectual property and all copyrights (and renewals thereof) secured therein. All commercial publication, dissemination and other rights in the data are reserved to NatureServe in all languages, formats and throughout the world for the sole and exclusive use or any other disposition by NatureServe or their assignees or grantees at any time and from time to time without any obligation or liability to any user.
Intellectual Property means all inventions, discoveries and improvements; all technical data including, but not limited to drawings, specifications, process information, technical reports and all other documented information and the like; and all computer software, databases and related documentation; and also includes all common law and statutory rights to the foregoing, including but not limited to, patents, copyrights, mask work registrations, and the like.
Warranties
All data are provided as is. NatureServe makes no warranty as to the currency, completeness, or accuracy of any specific data.
NatureServe shall have no liability for any claim of infringement or rights by third parties based on any use of the data in combination with programs, software, hardware, or equipment not designated by NatureServe, without prior written approval by NatureServe, if such infringement could have been avoided had the Licensed Dataset not been so used.
NatureServe shall have no liability or responsibility to any entity with respect to any liability, loss, or damage caused or alleged to be caused directly or indirectly by the data, including but not limited to any interruption of service, loss of business, anticipatory profits or indirect, special, or consequential damages resulting from the use or operation of the data.
Endorsement
The provision of this data does not necessarily constitute NatureServe or NatureServe’s Network Programs and other data providers’ agreement with the Data Requestors’ interpretation of the data.
Distribution
Distribution of the data or any intellectual property in whole or in part, or any products derived from the data or any intellectual property for commercial purposes is strictly prohibited.
Limitations of the Licensed Data
The data provided are for planning, assessment, and informational purposes. The data should not be considered a definitive statement on the presence, absence, or condition of biological elements at any given location. The lack of data for any geographic area in the data cannot be construed to mean that no significant features are present. Site-specific projects or activities should be reviewed for potential environmental impacts with appropriate regulatory agencies. If ground-disturbing activities are proposed on a site, the appropriate NatureServe Network Program(s) can be contacted for a site-specific review of the project area.
